Article 1 (Purpose)

These Terms govern the rights, obligations, and responsibilities between Baystate Asset Management Co., Ltd. (the "Company") and users in relation to the use of the company information and informational services provided through the website baystateam.com (the "Site"). Trading, subscription, and contracting of financial investment products are governed by separate agreements and prospectuses, not by these Terms.

Article 2 (Definitions)

  1. "Site" means the website (baystateam.com) operated by the Company to provide company information, investment areas, and insights.
  2. "User" means any person who accesses the Site and views information or uses services such as inquiries under these Terms.
  3. "Content" means all text, images, video, insights, and materials posted on the Site.

Article 3 (Effect and Amendment)

  1. These Terms become effective upon posting on the Site.
  2. The Company may amend these Terms within the scope permitted by law. Amendments will be posted on the Site 7 days before the effective date (30 days for changes adverse to users).
  3. Continued use of the Site after the amendment takes effect constitutes consent to the changes.

Article 4 (Service Provision and Changes)

  1. The Company provides the following services through the Site.
    • Company introduction, investment areas, operating principles
    • Market insights and investment materials
    • User inquiry reception and response
    • Hiring and announcements
  2. The Company may change or suspend services in whole or in part following prior notice for quality improvement.

Article 5 (Limitations and Required Disclosures)

  1. Content on the Site is for general information and does not constitute solicitation for any specific financial investment product or investment advice.
  2. Users should not make investment decisions based solely on Site content. Outcomes of investment decisions are the responsibility of the user.
  3. The Company does not guarantee accuracy or completeness of Site information and bears no liability under law for direct or indirect losses arising from its use.
  4. Performance and return figures shown are past results as of a specified date and do not guarantee future returns. All financial investment products may result in loss of principal; gains and losses belong to the investor.
  5. Advertising materials posted on the Site are reviewed under the Financial Consumer Protection Act and the KOFIA Advertising Regulations.

Article 6 (Limits on Product Introduction)

  1. Information about products on the Site is for general information and does not constitute an investment recommendation suited to any individual investor's financial situation, objectives, or risk tolerance.
  2. Actual subscription procedures include suitability/appropriateness assessments and delivery of the Key Product Information Document under the Financial Consumer Protection Act.
  3. Information about investment areas and products on the Site does not imply that products are available for subscription at all times. Solicitation and operation of specific products follow separate disclosures.

Article 7 (Intellectual Property)

  1. All copyrights and other intellectual property rights to Site content belong to the Company or rightful holders.
  2. Users may not reproduce, distribute, transmit, publish, broadcast, or otherwise use content for commercial or non-commercial purposes without prior written consent.
  3. Automated extraction (crawling/scraping) or use of insight content for AI training is prohibited without prior written consent.

Article 8 (User Obligations)

Users shall not engage in any of the following.

  1. Intentionally interfering with Site operations
  2. Identity theft or unauthorized collection of personal data
  3. Commercial use of Site information without consent
  4. Acts in violation of applicable laws

Article 9 (Financial Consumer Rights)

  1. In accordance with the Financial Consumer Protection Act, the Company informs financial consumers of the following rights.
    1. Right of withdrawal (FCPA §46)
    2. Right to terminate unlawful contracts (FCPA §47)
    3. Right to access records (FCPA §28)
    4. Right to dispute resolution (FCPA §36)
  2. In case of dispute, mediation may be requested through the Financial Supervisory Service Dispute Mediation Committee (dial 1332) or the Korea Consumer Agency.

Article 10 (Limitation of Liability)

  1. The Company is not liable when service is interrupted by force majeure, power outage, network failure, or other causes beyond reasonable control.
  2. The Company is not directly liable for gains or losses arising from user reliance on Site information.

Article 11 (Data Protection)

The Company processes personal data under the Personal Information Protection Act. Details are set out in the separate Privacy Policy. Changes such as processing entrustment or international transfer will be separately announced in compliance with Articles 17 and 26 of the Act.

Article 12 (Dispute Resolution and Jurisdiction)

  1. The Company and users shall endeavor to resolve disputes amicably.
  2. Users may submit feedback or complaints through the inquiry form on this site.
  3. Lawsuits relating to these Terms are subject to the courts of competent jurisdiction under Articles 2 and 18 of the Korean Civil Procedure Act. However, if the user qualifies as a consumer under the Framework Act on Consumers, they may bring proceedings before the court of their address or residence.

Supplementary Provisions

This is a v2 draft. It will take effect on the date of official enactment, following external legal review.
